These Terms of Use (“Terms”) govern your use of the Gustra iPhone application and the Gustra marketing website at gustra.net (together, the “Services”). By downloading, accessing, or using Gustra, you agree to these Terms.
1. The Services
Gustra is a personal restaurant review journal that lets you rate meals, attach notes and photos, view places on a map, and track culinary statistics. Features may change over time as we improve the App. The website at gustra.net provides product information, support, and legal pages.
2. Eligibility
You must be able to form a binding contract in your jurisdiction and meet any age requirements for the App Store in your region. If you use Gustra on behalf of an organization, you represent that you have authority to bind that organization.
3. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Gustra for your personal, non-commercial purposes on Apple-branded products you own or control, as permitted by the App Store Licensed Application End User License Agreement (“Apple EULA”) and any applicable Usage Rules.
4. Apple App Store terms
Gustra is distributed through the Apple App Store. Your use is also subject to Apple’s standard Licensed Application End User License Agreement, available from Apple, unless we provide a custom EULA that Apple accepts. In case of conflict between these Terms and the Apple EULA regarding your license to use the Licensed Application, the Apple EULA controls for that subject. Apple is not a party to these Terms and is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for Gustra. In the event of a failure to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation.
5. Your content
You retain ownership of the reviews, photos, notes, and other content you create in Gustra (“Your Content”). You are responsible for Your Content and for ensuring you have the rights to store and share it. You grant us only the limited rights needed to operate features you use (for example, processing a share or backup you initiate).
6. Acceptable use
You agree not to:
- misuse the Services, attempt to disrupt them, or reverse engineer the App except where allowed by law;
- use Gustra to store or share unlawful, infringing, or harmful content;
- interfere with map or places providers’ services in violation of their terms;
- misrepresent your identity or affiliation when contacting support.
7. Third-party services
Maps, place search, and other integrations are provided by third parties. Their terms and privacy policies apply to those services. We are not responsible for third-party outages, data accuracy (including restaurant information), or changes to third-party APIs.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that restaurant data, maps, scores, or backups will be uninterrupted, accurate, or error-free. Gustra is a personal journal tool and does not provide professional advice.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID FOR GUSTRA (IF ANY) IN THE TWELVE MONTHS BEFORE THE CLAIM, OR USD $10 IF YOU PAID NOTHING.
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
10. Indemnity
You agree to defend and indemnify us from claims arising out of Your Content or your misuse of the Services, to the extent permitted by law.
11. Termination
You may stop using Gustra at any time by deleting the App. We may suspend or stop providing the Services (including this website) at any time. Provisions that by nature should survive (including disclaimers, limitations, and indemnity) will survive termination.
12. Privacy
Our Privacy Policy describes how we handle information. Please read it carefully.
13. Changes to these Terms
We may update these Terms periodically. The “Last updated” date will change when we do. If you continue using the Services after changes become effective, you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules, unless mandatory consumer protections in your country of residence require otherwise. Courts in Amsterdam, the Netherlands, shall have non-exclusive jurisdiction, without limiting any consumer rights to bring proceedings in your home courts.
